There are no legal barriers for the participation of BDZ EAD in Public Procurement procedures

“Bulgarian State Railways” EAD would like to refute a statement of Sofia Mayor, Boiko Borisov, made in the context of the issue of the transportation of Sofia waste.
It is not correct to state that “Bulgarian State Railways” EAD were pronounced insolvent and therefore cannot take part in Public Procurement procedures.
In December 2006 the company “Bio Pharm” Ltd., based in Silistra, registered in Sofia City Court a motion for the initiation of proceedings for the pronouncement of the insolvency of “Bulgarian State Railways” EAD. In response to this appeal, Sofia City Court started court action No 2119/2006.
On 27th December 2006 Sofia City Court terminated the court action. The jurors judged that the appeal of “Bio Pharm” Ltd. is unacceptable as this company is not entitled to bring forth such a claim.
Currently, “Bio Pharm” Ltd. appealed before Sofia Appellative Court the decision of Sofia City Court for termination of court action. “Bulgarian State Railways” EAD registered a counter-appeal.
Therefore, there are no legal barriers for the participation of “Bulgarian State Railways” EAD in Public Procurement procedures.
